THE MOB
Participatory government does not exist in the US of A and it never did; but that not the problem: the problem is that the Democratic ?republican single party monolith does not believe in the rule of law it believes in mob rule
The entire form of the US government is based on the notion that man is evil and is predisposed to doing wrong, which is also a classically Conservative notion
So that when you practically apply and work through all of these various precepts and ideals, you will find that it like running a computer program: eventually they all crash and have to be amended. Except that modern day Conservatives ?the ones that lost the Civil War – want it to crash; and don let them kid you they are all Conservatives.
The 1st and most fundamental principle is not free speech or free expression, it the rule of law; the attempt to ban free speech is merely a symptomatic result of government straying away from the rule of law ?e.g., let have a vote, let lynch the Nigra, how many in favor say aye.
So right off the bat we see the first and foremost product of infant western thought symptomatic medicine
The problem is in how the symptoms are dealt with. If the President for example strays from the rule of law what happens? Is this a high crime or misdemeanor? Where is that written ?e.g., let have a vote, let impeach the President ?an if?he happens ta be a Nigra let lynch m, how many in favor say aye.
In actuality, if the rule of law were adhered to then the form of government would be unimportant. So the form of government we adopted was either in response to known empirical abuse as documented in Montesquieu pirit of the Laws?and/or the presumption or belief that these sorts of things will always happen
So all of these apparently insurmountable problems we hear Congress whining about ?e.g., campaign finance reform – really have absolutely nothing to do with the government or the rule of law, they are the symptomatic results of mob rule ?e.g., let have a vote to see who gonna be dictator. Let listen carefully to determine how clever which little shit is going to be in devising some new national security threat and then wel buy enough voters to ensure his victory: because the truth is, not only do these other little shits not believe in the rule of law they have for the last 62 years found pretence to suspend it. Before Truman crew invented the Cold war, it was Rent Control. Il even supply the US Supreme Court Case on edit to prove it.
So how does this form of government prevent these things from happening? It doesn and thus Central Planning devolves to majority building ?e.g., who going to force people to disclose all private medical and financial information in order to get a driver license on account of rent control? Or get padded down, essentially frisked, having your purse and other private effects rifled through by grubby little fingers in order to get inside a courthouse?
Now in NYS you have to go through all of this shit first at the Country Clerk Office: (1) buy an index number: last I knew $175.00 but Judge Kaye demands a $50,000 a year raise for all Judges and she a gonna sue Eliot herself if he don just imme the fuckin?money?so maybe she raised that fee too ?look Eliot the money for our raise, it right chere !!); (2) A request for judicial intervention: used to be $75.00 last I knew. What really ought to be done is just change the US of A motto from E pluribus Unum to ust gimme the fuckin?money? and (3) Now pay another $50.00 before they even let you get out of the hallway inside a room.
So the monolith needed something big, not just the Gulf of Tonkin: having a US ship attacked by the US, if it was ever attacked at all; and then blaming it on inland rice farmers whom were subsequently destroyed as a US National security threat: probably on behalf of the same folks that made agent orange: but 1st let have a vote, how many in favor of raping their women and farm animals say Aye. So this time around they had a few volunteers fly an airplane into the world trade center?
Now think about that for a minute. Private property was destroyed and oh yeah people were killed, correct? Do we do away with due process because people still murder? Is that next? It already happened ?/P>
William O. Douglas as an associate Justice of the US Supreme Court authored a number of cases dealing with the rights of pro se litigants and dealt with these in terms of violations of due process and equal protection. The Conservatives didn like it.
You see it far easier for a Judge to gain control over a lawyer than it is a pro se (a pro se litigant is a person who represents themselves); and control is the name of the game.
In terms of controlling the lawyer, he has to argue before the Judge. If the lawyer won take a dive when the Judge wants the other party to win ?e.g., a large Conservative Party corporation, or more likely, a friend or local government official – then maybe this lawyer is going to have a difficult time winning any cases before this Judge or other Judges that agree on the particular case outcome at hand, thus his career is ruined, he has to relocate, run for office or just knuckle under and submit.
So the plan being executed right now is to undo all of the Douglas decisions dealing with due process and equal protection regarding pro se litigants. Because youe all doing your ipods, computer games and not paying attention: there will come a time where someone like the Nazi officer in the film chindler List?says ?{paraphrase} The Jews came into our land took over our institutions our way of life our culture, from this day on ?it never happened.
Hence those rights never happened.
Step 1 was Herr McCain, the white haired guy that was a POW in Viet Nam doing away with damage actions. Putting a cap on them &c &c. Like Mr. Slatan recently commented, if you can get a million dollars in damages no social parasitic liar is going to take your case. Ironically it seems the Libertarians are on the same kick. In short if youe rich and you hurt somebody you merely negotiate as to how much you have to pay in order to enjoy the perpetration of mayhem or whatever. And thus,
Step 2 was prosecutorial immunity and discretion ?no one in charge of enforcing the law has to, if youe injured in fact, sue in civil court
And what does this amount to? If government or a private entity wants to hurt you the amount they might have to pay has already been limited. This way they can make a value judgment ?e.g., can I afford to hurt this guy for $100 grand? The trend now with Judges like Herr Rose (NYS 6th District 3rd Dept) is to award no damages at all. So if someone in the government or someone with juice wants to hurt you and you can represent yourself, your only choice will be to rent a liar under the thumb of someone like Herr Rose. Rose dismisses your case, youe out $5,000.00 or whatever social parasitic liars are charging poor people these dayz for bogus civil litigation ?viz., they hold your hand after taking a dive and say est assured you made them pay for their defence?part of which you may end up paying for anyway and the injustice and injury goes with impunity, anyway. Government doesn pay, you do. Then what recourse have you? Oh boy I mad I going to vote for some politician that will pass a law that Judges like Herr Rose will say fuck you to.
So these are the sorts of things your representatives spend their time creating, all of which is antithet to fairness and justice, and merely deals with mob rule.
The solution is the rule of law.
It all comes down to a matter of choices and personal challenges ?viz., which ones do you take up and which ones do you walk away from.
The reason the US of A is a failure and really has become nothing more than a big company store or a stockade filled with consumers for the private sector to ruthlessly exploit is because people refuse to learn the law or more importantly he reason of the law?/P>
Money and fucking really isn the answer but right now that what everything is geared towards. The Conservatives through Heterosexual marriage; and the only alternative allowed are these white guyz from the Confederacy registered as Democratics saying give m a little slack and leeway, but if they get outta line wel snap that collar ound their neck just as hard as you do. If they convince Conservative followers they mean it, then they get elected to the White House ?code word e need change?
All you have to do is watch C-Span to get the drift, observe how people in government office act towards you and treat you. This is all most people know and all that they base their decisions on.
But once you learn and understand the law and compare it to how these people behave, what they do &c then you realize what utterly worthless shmucks and parasites they all are.
Essentially what they want and do is so much in conflict with the rule of law they have to suspend it, otherwise they can operate. They don know how.
What do you do about it? I not your leader. So the first thing you have to decide is whether you want to be a free individual or a subject; the monolith wants you to be the latter and it the easiest way to go. Trillions have been spent convincing you already.
